These Terms of Service (“Terms”) govern your access to and use of Terpeneation (the “Service”), a community platform operated by Terpeneation (“Company,” “we,” “us,” or “our”). The Service enables users to connect, share text, images, and videos, and offers paid membership levels with enhanced features.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not access or use the Service.
You must be at least 21 years of age or the age of majority in your jurisdiction of residence to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you are not barred from using the Service under applicable law. The Service permits non-penetrative nudity in user-generated content where it complies with our Content Guidelines; however, such content is not the primary focus of the platform, which is designed for general community interaction and sharing.
Certain features of the Service require you to create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
The Service offers free and paid membership tiers. Paid memberships are provided on a subscription basis (monthly or annual) and grant access to additional features such as increased storage, priority visibility, and exclusive community tools.
Payments are processed by third-party payment processors. We do not store full payment card information.
Subscriptions automatically renew unless canceled before the renewal date.
Pricing is subject to change with at least 30 days’ notice via email or in-app notification.
All fees are non-refundable except as required by applicable law or our explicit refund policy.
You are responsible for all taxes applicable to your use of the Service.
You retain ownership of any text, images, videos, or other materials you upload, post, or transmit via the Service (“User Content”). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, distribute, display, perform, and modify (solely for formatting and technical purposes) your User Content as necessary to operate, promote, and improve the Service. This license survives termination of your account.
You are solely responsible for your User Content and represent that it does not infringe any third-party rights or violate these Terms.
The Service maintains community standards that reflect its primary purpose as a general-interest platform. Non-penetrative nudity is permitted only when it is incidental, artistic, or casual in nature and complies with the following prohibitions. You agree not to upload, post, or transmit any User Content or engage in any conduct that:
Violates any applicable law or regulation, including the creation, distribution, or possession of child sexual abuse material (zero-tolerance policy; we will report such content to authorities).
Depicts penetrative sexual acts, explicit pornography, or content whose primary purpose is sexual gratification.
Constitutes harassment, bullying, hate speech, discrimination, or threats.
Infringes intellectual property rights, privacy rights, or publicity rights of any third party.
Contains spam, unsolicited commercial messages, or malware.
Promotes illegal activities, violence, or self-harm.
Impersonates any person or entity or misrepresents your affiliation with any person or entity.
We reserve the right, but have no obligation, to review, moderate, remove, or disable access to any User Content that violates these Terms, at our sole discretion and without prior notice. Repeated violations may result in account suspension or termination.
The Service and all original content, features, and functionality (excluding User Content) are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of our content without our prior written consent.
We respect copyright law. If you believe User Content infringes your copyright, please submit a DMCA notice to [legal@[Company Domain]].com containing the required elements under the Digital Millennium Copyright Act.
We may suspend or terminate your account and access to the Service at any time, with or without notice, for violation of these Terms, non-payment of fees, or any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately, but any licenses you granted us and any outstanding payment obligations survive. You may cancel your subscription or delete your account at any time through your account settings.
The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.
To the fullest extent permitted by law, Terpeneation shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Service. Our total liability shall not exceed the greater of one hundred U.S. dollars (USD $100) or the amount you paid to us in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless Terpeneation, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with (i) your User Content, (ii) your violation of these Terms, or (iii) your violation of any rights of another party.
These Terms are governed by the laws of the State of Oregon, United States, without regard to conflict-of-laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in [County, State].
We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms with a new “Last Updated” date and, where feasible, by email or in-app notice. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
These Terms constitute the entire agreement between you and us. If any provision is held invalid, the remainder remains in full force. Our failure to enforce any right does not constitute a waiver.
